Thus, the Right to Free and Compulsory Education Act 2009 was enacted by the Parliament to ensure a collective effort for the primary education of the child and to ensure responsibility at that level as well. This law is known as RTE (Right to Education) 2002 or “Right to Education”. Some important provisions have been made for primary education under the Right to Education Act. Based on these provisions, the state government has passed some important resolutions.
No one can say in court to acquit himself after committing a crime that I did not know the law that stealing or murder is a punishable offense, even if he says so the court will not accept it because he is over 18 years of age. The citizen has to study the Constitution of India on his own or assume that he knows. Just as it is the sole duty of a person above 18 years of age to know the Constitution of India as well as the law, laws, our rights and duties as a citizen of India, so it is the sole duty of a teacher to know RTE 2009 and the changes made in education under it.
Some important provisions have been made for primary education under the Right to Education Act. Based on these provisions the state government has to work out some important resolutions. Let’s take a look at these resolutions.
No child enrolled in a school shall be barred or expelled at any standard upon completion of elementary education.
Admission of out-of-school children. To avail the benefit of any scheme run by Sarva Shiksha Abhiyan Mission for out of school children.
No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.
No teacher may engage in private tuition or private teaching activity.
No school or person shall charge any capitation fee at the time of enrolling a child in the school and shall not pass the examination or interview to the child or his guardian for admission in the school.
During the academic year, for Std. 1 to 8, 200 working days and at least 200 hours of educational work per year should be done.
During the academic year, for Std. 6 to 8, 30 working days and at least 1000 hours of academic work per year will have to be done.

Structure of School Management Committee i.e. SMC.
The school management committee will have 12 members of which 5% (2) members will be the parents or guardians of the children studying in the school, in which the parents of the children belonging to the disadvantaged group and the weaker section will have to be given proportional representation.
The remaining 5% members should include the following persons.
One member is an elected member of a local body decided by a local body (Gram Panchayat / Nagar Shikshan Samiti).
The teacher who decides the teachers from a member school teachers.
A member decides the parents to be included in the committee from the local educationist / school children.
Local link (a link to a village next to a village that does not have a link). This member shall be appointed by the Chairman of SMC.
The school principal or where the school does not have a principal will become the member secretary of the SMC by the rank of school teacher.
SMC meeting has to be called every three months. The Member Secretary shall convene the meeting and take note of it.
Functions and Duties of School Management Committee (SMC):
Supervise and control school operations.
Prepare and recommend school development plan.
Supervise / control the use / utilization of grant (money) received from State Government or local body or any other source.

To give the parents of the students an understanding of their duties.
RTE 2009 will ensure implementation of various clauses.
To maintain supervision and control to ensure that non-academic duties are not assigned to teachers as per Section 8 of RTE 2009.
Supervise and control the maintenance of standards and norms for the school specified in the Schedule to the Free and Compulsory Education for Children Act, 2006.
Supervise and plan for all timely benefits to children.
To implement the provisions of Section 4 of RTE 2009, a plan has been prepared to determine the needs of children who are denied admission or who have not completed primary education.
Monitoring / controlling the identification of children with disabilities and their enrollment learning facilities as well as ensuring their participation in completing their primary education.
Supervise / control the implementation of mid-day meal scheme for school children.
To prepare annual accounts of school income and expenditure.
In order to discharge its duties and responsibilities under the Act, the School Management Committee shall maintain separate accounts for the funds received and show them for audit every year.
To carry out construction, maintenance and repair works of school building through public participation and to inspect / supervise.
Proper use of funds available in school development / improvement programs, purchase of goods from competitively priced merchants by asking for competitive prices should be done in a quality and economical manner as per school requirement and for school purpose as per scheme guidelines.
Note: – SMC has revoked the appointment and dismissal power of lunch manager, cook and assistant as per the letter of the Education Department dated 06/09/2011 amended Resolution No. PRE 16-6-K dated 07-11-2011 and returned to Mamlatdar.
According to the amendment resolution of SMC dated 3-02-2011, the meeting of SMC will have to be held every three months instead of every month and Kadia will have to perform his duty as a co-opted member and Kadia will not have the right to vote.
It is very important for SMC members, teachers, principals, project staff of Sarva Shiksha Abhiyan to be monitored and guided by the members of Panchayati Raj Institute (PRI) for the implementation of RTE 2009 Act. The guidance of Panchayati Raj members will help in completing the project targets on time.
